1. Introduction

Welcome to Choice Properties. This document establishes the full legal, operational, and communication framework governing the use of our platform.

By accessing, using, or submitting an application through Choice Properties, you agree to all terms outlined in this document.

2. Platform Overview

Choice Properties is a rental marketplace platform that connects applicants with property owners, management companies, and authorized agents.

Our role is to:

  • Advertise rental properties
  • Collect and organize applications
  • Facilitate communication and processing
  • Provide structured workflows for rental transactions

Choice Properties does not:

  • Own listed properties
  • Guarantee approval
  • Make final leasing decisions

All final decisions are made by the property owner or their authorized representatives.

3. Application-First Model

Choice Properties operates a structured application-first system. By using this platform, you acknowledge:

  • Applications are required before property access or viewing
  • Screening is conducted prior to approval
  • Viewing may occur after approval or lease-stage processes

This system ensures: serious applicants, efficient processing, and fair and consistent evaluation.

4. Application Process

When submitting an application:

  • Your information is securely collected
  • Your application is reviewed for completeness
  • Payment coordination may occur before review
  • Applications enter formal review only after required steps are completed

Submission does not guarantee approval.

5. Application Review Timeline

Applications are processed dynamically based on completeness and responsiveness.

Typical review timeframe: 24 to 72 hours after payment confirmation.

Faster approvals may occur when applicants:

  • Submit complete and accurate information
  • Provide required documentation early
  • Respond promptly to communication
  • Demonstrate stable income and qualifications

Delays may occur if:

  • Information is incomplete
  • Additional verification is required
  • Applicant is unresponsive

6. Applicant Responsibilities

Applicants agree to:

  • Provide accurate, complete, and truthful information
  • Submit all required documentation
  • Respond to communication in a timely manner

Providing false or misleading information may result in denial or removal.

7. Application Fee & Credit Policy

Application fees are required for processing applications, are disclosed before collection, and are collected after submission through coordinated payment. Application fees are non-refundable once payment is confirmed and are required before review begins.

Reapplication Protection:

  • If denied, applicants may reapply within 30 days without paying a new fee
  • Application credits may be issued and remain valid for up to 60 days
  • Credits are non-transferable and cannot be exchanged for cash

8. Holding Deposit Policy

Approved applicants may be required to submit a holding deposit to reserve a property.

Holding deposit terms:

  • Must be paid within the specified deadline (typically 24–48 hours)
  • Secures the property and removes it from the market
  • Is fully credited toward move-in costs

Failure to proceed:

  • If the applicant withdraws or fails to sign the lease, the deposit may be forfeited
  • If the property becomes unavailable due to no fault of the applicant, the deposit may be refunded

9. Refund & Applicant Protection Policy

Choice Properties prioritizes fairness and transparency. Applicants may qualify for refunds where:

  • The property materially differs from its advertised condition
  • The transaction cannot be completed due to verified issues
  • The property becomes unavailable after payment

Refund conditions: requests must be submitted within a reasonable timeframe and are subject to verification.

Non-refundable cases: change of mind, failure to complete required steps, voluntary withdrawal.

10. Property Information Disclaimer

Property information is provided by property owners and third parties. Choice Properties does not guarantee accuracy, completeness, or availability. Applicants are responsible for verifying details during the process.

11. Payment Terms

All payments must be completed before the next stage of processing, are considered final once confirmed, and must not be reversed without valid cause.

Unauthorized disputes or chargebacks may result in application cancellation, account restriction, or legal action.

12. Privacy Policy

Choice Properties is committed to protecting your information. We collect only necessary personal and financial data, store data securely, and share data only with relevant property parties. We do not sell personal data or share data for unrelated purposes.

13. Communication Policy

By using the platform, you consent to receive emails, text messages, and application updates. These may include payment coordination, status updates, and administrative communication.

SMS consent. By providing your mobile number and submitting an application, you expressly consent to receive transactional SMS messages from Choice Properties relating to your application, payment coordination, lease, and move-in. Consent to receive SMS is not a condition of any purchase. Message frequency varies. Message and data rates may apply. Reply HELP for help. Reply STOP at any time to opt out of SMS; opting out of SMS does not remove you from email communications necessary to process your application.

14. Fair Housing Policy

Choice Properties complies with all applicable fair housing laws. We strictly prohibit discrimination based on race, color, religion, sex, national origin, disability, familial status, or any protected class under applicable law.

15. Legal Protections & Governance

Governing Law

All matters are governed by the laws of the state in which the property is located, except that platform-level matters not specific to a property are governed by the laws of the State of Michigan, without regard to conflict-of-law principles.

Dispute Resolution & Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute, claim, or controversy arising out of or relating to your use of Choice Properties shall be resolved through final and binding individual arbitration administered under the Consumer Arbitration Rules of the American Arbitration Association (AAA), where permitted by law. Arbitration shall take place in the State of Michigan or, at your election, in your home state. The arbitrator's decision shall be final and may be entered as a judgment in any court of competent jurisdiction.

Either party may bring an individual claim in small-claims court for disputes within that court's jurisdiction in lieu of arbitration. Nothing in this section prevents either party from seeking injunctive or equitable relief in court for intellectual-property infringement or unauthorized access.

Class Action Waiver

YOU AND CHOICE PROPERTIES AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding. If this class-action waiver is held unenforceable as to any particular claim or remedy, that claim or remedy (and only that claim or remedy) shall be severed and brought in a court of competent jurisdiction; all other claims shall remain subject to arbitration.

Electronic Consent

Users agree that digital signatures are legally binding and that electronic agreements are enforceable, pursuant to the federal Electronic Signatures in Global and National Commerce Act (ESIGN Act, 15 U.S.C. § 7001 et seq.) and applicable state law.

Eligibility

Users must be at least 18 years old and have legal capacity to contract.

Service Availability

Choice Properties does not guarantee uninterrupted service. Features may change or be temporarily unavailable.

Platform Rights

We reserve the right to reject applications, restrict or terminate access, and modify platform functionality.

Limitation of Liability

To the maximum extent permitted by law, Choice Properties is not liable for indirect, incidental, special, or consequential damages, third-party actions, or property-related outcomes. Total aggregate liability is limited to the amount paid by the user to Choice Properties in the twelve (12) months preceding the event giving rise to the claim, or one hundred U.S. dollars ($100), whichever is greater.

Force Majeure

Choice Properties is not responsible for delays or failures in performance caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, civil disturbance, government action, labor disputes, utility or telecommunication failures, and outages of third-party infrastructure providers.

16. Property Access & Viewing Policy

Applicants acknowledge that viewing may occur after application or approval stages, and that access is granted only after required steps are completed. This is part of the structured application-first system described in Section 3.

17. Policy Updates

Choice Properties may update this document at any time. Continued use of the platform indicates acceptance of updates. A history of material changes is maintained on the Policy Changelog.

18. Acceptance

By using this platform, you confirm that you have read, understood, and agreed to all terms in this document.
