1. About Choice Properties

Choice Properties ("we," "us," "our," or "the Platform") is an online rental marketplace that connects prospective tenants with independent property owners, landlords, and real estate agents. We do not own, manage, or control any property listed on our platform. Choice Properties is a technology facilitator — we are not a landlord, property manager, leasing agent, or real estate brokerage.

2. Acceptance of Terms

By accessing or using Choice Properties in any capacity — as a visitor, tenant-applicant, landlord, or agent — you agree to be bound by these Terms of Service, our Privacy Policy, and any additional policies linked from this page. If you do not agree, do not use our platform.

3. Who Can Use This Platform

  • You must be at least 18 years of age to submit a rental application or create a landlord account.
  • You must provide accurate, complete, and truthful information. Providing false information is grounds for immediate account suspension and may be referred to relevant authorities.
  • You are responsible for all activity that occurs under your account or your submitted application.

4. Platform Role — What We Do and Do Not Do

Choice Properties provides:

  • A marketplace to browse available rental listings
  • Tools for landlords and agents to advertise properties
  • An application submission and tracking system
  • Communication tools between parties
  • Lease generation and e-signature facilitation

Choice Properties does NOT:

  • Guarantee approval of any rental application
  • Guarantee the accuracy or availability of any listing
  • Act as a party to any lease agreement
  • Manage or maintain any property
  • Process physical payments (application fee and holding deposit payments are collected by landlords or their agents outside of our platform, facilitated through our application system)

5. Listings

All listings are posted by independent landlords and agents. Choice Properties does not verify the accuracy of every listing. We reserve the right — but accept no obligation — to remove listings that violate our policies, appear fraudulent, or have been reported by users.

Landlords are solely responsible for the accuracy of their listings, compliance with applicable law, and the decisions they make regarding tenant selection.

6. Applications

Submitting an application does not guarantee approval, reserve a unit, or create any tenancy. Approval is at the sole discretion of the landlord or agent managing the property. The platform follows a single, consistent flow: Apply → Payment → Review → Approval → Reservation → Lease → Move-In. Applications are activated for review only after the application fee is completed and are typically processed within 24 to 72 hours. Due to demand, multiple applications may be reviewed for the same property.

7. Fees

Application fees are set by the landlord or agent for each individual property listing. Fees are displayed before you submit your application. Nothing is charged at submission — our leasing team contacts you after submission to securely complete payment. By submitting your application and completing payment, you acknowledge and agree that:

  • The application fee is non-refundable except as described in the Application Credit Policy
  • The fee covers processing of your specific application for that specific property
  • Payment of the fee activates your application for review but does not guarantee approval or create any tenancy

8. Application Credits

If your application is not approved after payment, you may receive application credits as described in the Application Credit Policy. Credits are subject to the terms and conditions of that policy.

9. Holding Deposit

If selected, you may be asked to pay a holding deposit to reserve the property and remove it from active availability while your lease is prepared. The holding deposit is fully credited toward your move-in costs — it is not an additional charge. Holding requests are time-sensitive and typically must be completed within 24 to 48 hours; if not paid in time, the property may be released to other approved applicants. The terms, refundability, and conditions of the holding deposit are governed by the Holding Deposit Policy.

10. Electronic Signatures

Lease agreements executed through the Choice Properties platform are legally binding electronic signatures pursuant to the federal Electronic Signatures in Global and National Commerce Act (ESIGN Act, 15 U.S.C. § 7001 et seq.) and applicable state law. By signing electronically, you agree that your signature has the same legal effect as a handwritten signature.

11. Landlord Obligations

Landlords and agents using this platform agree to:

  • Post only accurate, current, and lawful listings
  • Comply with the federal Fair Housing Act, applicable state fair housing laws, and all local rental regulations
  • Not discriminate against any applicant based on race, color, national origin, religion, sex, familial status, disability, or any other class protected by applicable law
  • Respond to inquiries and applications in a reasonable timeframe
  • Promptly update listing status when a unit is no longer available

Violation of these obligations may result in listing removal and account suspension.

12. Prohibited Conduct

You may not use this platform to:

  • Post false or fraudulent listings
  • Submit applications using another person's identity
  • Abuse the application credit system (e.g., intentional applications submitted solely to obtain credits)
  • Engage in any activity that harasses, harms, or defrauds another user
  • Circumvent, disable, or interfere with platform security features
  • Use automated bots, scrapers, or tools to access platform data

13. Data and Privacy

Your use of this platform is governed by our Privacy Policy, which is incorporated by reference into these Terms. Please read it carefully.

14. Platform Availability and Changes

We make no guarantee of uninterrupted service. The platform may be updated, modified, or temporarily unavailable at any time. We reserve the right to change these Terms at any time. Continued use of the platform after changes are posted constitutes acceptance of the revised Terms.

15. Disclaimer of Warranties

The platform is provided "as is" without warranties of any kind, express or implied. We do not warrant that listings are accurate, that applications will be approved, or that the platform will be free of errors or interruptions.

16. Limitation of Liability

To the maximum extent permitted by law, Choice Properties shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including but not limited to loss of a tenancy opportunity, application fees paid, or damages arising from landlord decisions. Total aggregate liability of Choice Properties to you is limited to the amount you paid to Choice Properties in the twelve (12) months preceding the event giving rise to the claim, or one hundred U.S. dollars ($100), whichever is greater.

17. Governing Law

These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law principles, unless a specific federal or state law mandates otherwise for housing-related matters. Property-specific matters are governed by the laws of the state in which the property is located.

18. Dispute Resolution & Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute, claim, or controversy arising out of or relating to your use of Choice Properties shall be resolved through final and binding individual arbitration administered under the Consumer Arbitration Rules of the American Arbitration Association (AAA), where permitted by law. Arbitration shall take place in the State of Michigan or, at your election, in your home state. The arbitrator's decision shall be final and may be entered as a judgment in any court of competent jurisdiction.

Either party may bring an individual claim in small-claims court for disputes within that court's jurisdiction in lieu of arbitration. Nothing in this section prevents either party from seeking injunctive or equitable relief in court for intellectual-property infringement or unauthorized access.

19. Class Action Waiver

YOU AND CHOICE PROPERTIES AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding. If this class-action waiver is held unenforceable as to any particular claim or remedy, that claim or remedy (and only that claim or remedy) shall be severed and brought in a court of competent jurisdiction; all other claims shall remain subject to arbitration.

20. Force Majeure

Choice Properties is not responsible for delays or failures in performance caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, civil disturbance, government action, labor disputes, utility or telecommunication failures, and outages of third-party infrastructure providers (including Cloudflare, Supabase, Google, ImageKit, and our payment partners).

21. Communication & SMS Consent

By using the platform and providing your contact information, you consent to receive emails, text messages, and application updates from Choice Properties. These may include payment coordination, status updates, lease processing, and administrative communication.

SMS consent. By providing your mobile number and submitting an application, you expressly consent to receive transactional SMS messages from Choice Properties relating to your application, payment coordination, lease, and move-in. Consent to receive SMS is not a condition of any purchase. Message frequency varies. Message and data rates may apply. Reply HELP for help. Reply STOP at any time to opt out of SMS; opting out of SMS does not remove you from email communications necessary to process your application.

22. Application-First Model & Property Access

Choice Properties operates a structured application-first system. By using this platform, you acknowledge that:

  • Applications are required before property access or viewing
  • Screening is conducted prior to approval
  • Viewing may occur after approval or lease-stage processes, and access is granted only after required steps are completed

This system ensures serious applicants, efficient processing, and fair and consistent evaluation across all listed properties.

23. Acceptance of Terms

By using this platform — including browsing listings, creating an account, submitting an application, or signing a lease — you confirm that you have read, understood, and agreed to these Terms of Service, the Privacy Policy, and all related policies referenced above. The applicant consent checkboxes presented at application submission are timestamped and stored as evidence of your acceptance.
